Employers are responsible for employee safety. It is the responsibility of employers to complete a hazard assessment and to seek out and weigh the risks of the hazard and the controls being used and to know the pertinent legislation that surrounds the hazard and the controls being used. Employers cannot ask employees to disclose medical/health information without signed consent. No disciplinary action can be taken against employees who know and follow their rights under the law.
